What Is a Proffer Analysis?

In Virginia, when a developer seeks a rezoning or a proffer condition amendment for new residential development, a locality may accept voluntary proffers to address certain capital impacts associated with that development. These proffers are governed by Section 15.2-2303.4 of the Code of Virginia, which took effect on July 1, 2016. The statute applies to new residential development, including the residential component of a mixed-use development, when the proposal requires a rezoning or proffer condition amendment.

Under the law, a proffer is considered reasonable only if it addresses an impact specifically attributable to the proposed development. For off-site proffers, which include all cash proffers, the development must create a need, or an identifiable portion of a need, for public facility improvements beyond existing capacity, and the development must receive a direct and material benefit from those improvements.

The statute limits eligible public facility categories to public schools, public safety facilities, public transportation facilities, and public parks. It does not permit proffers to fund operating expenses, ordinary maintenance or repair, or capital improvements to existing facilities that do not expand capacity.

Because of these requirements, a well-prepared proffer analysis is an important part of the rezoning process. A sound analysis helps document the relationship between a proposed development and its public facility impacts, supports the reasonableness of any proposed contribution, and helps establish a clear nexus between the development and the improvement being funded.

What We Evaluate

Each proffer analysis examines the development's proportional impact across the public facility categories applicable under Virginia law:

  • Public school facilities, including enrollment projections by school level and comparison against existing capacity at zoned schools
  • Fire and rescue facilities, based on the development's projected service population and planned capital improvements
  • Law enforcement facilities, evaluated against adopted staffing ratios and existing service capacity
  • Parks and recreation facilities, assessed using adopted Level of Service standards and programmed capital expenditures

Our Methodology

Proffer calculations begin with a demographic analysis that establishes the projected population and school-age children associated with the development at full buildout and occupancy. Student generation rates are applied by school level and housing type to estimate enrollment impacts. For each public facility category, we compare projected demand against existing capacity and identify whether a direct capital impact exists.

Where an impact is identified, we calculate a proportional per-unit contribution based on documented facility costs, adopted capacity standards, and the development's projected share of the service population. Where existing capacity is sufficient to absorb the development's incremental demand, no contribution is recommended for that facility category.
